The fight to protect mothers and babies from the harms of chemical abortion continues in the courts — and we are asking Acting Attorney General Todd Blanche to intervene on the side of Life. The State of Louisiana and abortion drug coercion survivor Rosalie Markezich have filed a powerful new brief asking the 5th Circuit Court of Appeals for expedited review in their lawsuit against the FDA. At stake is the Biden-era policy that removed critical in-person safety protections and allowed dangerous abortion drugs to be shipped through the mail.
Todd Blanche is in a position to immediately settle this case and restore common-sense safeguards. All he has to do is agree to a court-ordered consent decree that would end Biden’s unlawful mail-order abortion drug policy and restore in-person dispensing immediately while the FDA completes a prompt, rigorous safety review.
The consequences of continued inaction are devastating. Post-Dobbs pro-life laws are being nullified by mail-order drugs. An estimated 15,000 babies are lost every month in states with pro-life protections. Women are suffering serious physical and emotional harm, often in cases involving coercion and abuse.
Public opinion is clearly on the side of safety: Nearly 7 in 10 Americans support removing these dangerous drugs from the mail, and pro-life voters are watching closely. Failing to act would be a serious political mistake.
The State of Louisiana’s legal brief highlights how the Biden administration violated the Administrative Procedure Act by ignoring safety data and pushing the policy for political reasons following the Dobbs decision. The 5th Circuit previously halted the mail-order policy, but the Supreme Court allowed it to continue during litigation.
Recent tragedies make the urgency clear. Just last week, a Louisiana man was charged with felonies after secretly giving an abortion drug to a pregnant woman, resulting in an emergency delivery at 23 weeks. PRI has also documented multiple cases of women poisoned by these drugs, including the heartbreaking story of Jona Affholder, who was force-fed the pills by her ex-husband.
Disturbing new data from the Charlotte Lozier Institute reveals that 81% of online abortion sellers ship mifepristone beyond the FDA’s 10-week limit, dramatically increasing risks to women. Studies show that three-quarters of emergency room visits after chemical abortion are coded as severe or critical, with more than 1 in 10 women experiencing at least one major complication such as hemorrhage, infection, or sepsis.
We can’t build a culture that values every human life if the abortion pill continues to be recklessly, dangerously, and even criminally used to end a half million lives each year.
