In what could be the abortion legal battle of the decade, the U.S. Supreme Court has decided to weigh in on the Texas abortion regulation law. The case will have far-reaching and long-lasting consequences for women’s health. It will determine whether the unregulated and unaccountable abortion industry will be able to continue business as usual, ignoring the health of women in pursuit of profits.
The Supreme Court’s decision on the case could have a domino effect on similar laws in other states including Pennsylvania, Michigan, Missouri, and Virginia. It will set an important precedent for the amount of oversight that states will be allowed to have over the abortion industry.
The recent videos revealing the Planned Parenthood organ harvesting scandal are just one illustration of how the abortion industry needs greater oversight and accountability, not less.
The Texas abortion regulations were passed by the Texas State Legislature in the summer of 2013 and signed into law by then-Governor Rick Perry. The law requires that all clinics adhere to the basic facility standards set for an ambulatory surgical center. It also requires that abortionists have admitting privileges to a nearby hospital in the event that life-threatening complications should arise. Most abortion clinics in the State have since shut down because they were unable, or unwilling, to comply with these basic health regulations.
Allowing abortion businesses to operate without having to adhere to the basic standards required of all ambulatory surgical health facilities clearly places mothers’ health at risk, reduces the standard of women’s health care, and jeopardizes countless unborn lives.
In some circumstances, induced abortion can permanently harm a woman’s health and can place her life at risk. There is no doubt that abortion becomes increasingly more risky for the mother at later gestations.
But that’s not the only problem.
More women are choosing to abort in the second trimester (13-27 weeks gestation) as prenatal screening has become widely available, allowing expectant mothers to select out unwanted children with congenital anomalies, heart conditions, or skeletal deformities. Given the widespread prevalence of prenatal screening, it is highly unlikely that multiplying the number of abortion clinics will eliminate the significant number of late-term abortions. Most fetal abnormalities are not detected until after 14 weeks gestation. According to Guttmacher figures for 2004, up to one-third of all second trimester abortions could be due to reasons of fetal deformity and congenital anomalies.
Is it really responsible to toy with women’s lives by making abortion facilities unaccountable to standards required of all other ambulatory surgical facilities in the state? In the case where a life-threatening complication might arise, shouldn’t women have guaranteed access to quality emergency care?
Abortion advocates have argued that abortion is a safe procedure—an argument that is suspect in its own right. But if they’re right – if abortion is as safe as having your tonsils removed – why should abortion clinics be exempt from the same regulations as health facilities that remove your tonsils?
Adopting standards for ambulatory surgical centers are not onerous or discriminatory requirements. The standards required of abortion clinics required by the Texas law are simply those where “a facility that operates primarily to provide surgical services to patients who do not require overnight hospital care.” It’s not as if Texas abortion facilities are being required to adopt standards in accord with inpatient surgical facilities or hospitals.
The abortion industry in the United States is among the least regulated in the world. In Sweden, a largely pro-abortion country that gives more money to Planned Parenthood than any other nation, abortion is only legal up to 18 weeks gestation unless the life or health of the mother is at serious risk. The gestational limit in Sweden is in fact stricter than Texas’ which allows abortion for any reason up to 20 weeks. Swedish women who want to have an abortion after 12 weeks are required to receive counseling before having an abortion and after 18 weeks, women have to make a case before the National Board of Health and Welfare before they can receive permission to have an abortion. The National Board reviews cases individually on a case-by-case basis.
There is much reason to speculate that the Supreme Court will rule against the Texas law. The Court has been preventing the law from being implemented after the Fifth Circuit of the U.S. Court of Appeals ruled in favor of the Texas abortion regulations protecting women’s health and instituting accountability among abortion clinics in the state.
But what can Americans do if the Supreme Court callously nullifies the Texas law protecting mothers and their children?
The most effective means is for Congress to use its powers under article 3, section 2 of the Constitution and simply remove from the federal courts the jurisdiction any jurisdiction over cases involving abortion. The vast majority of Americans are unsatisfied with current abortion laws, because they are the plaything of unelected federal judges with lifetime appointments to the bench. That’s why the founders conferred on the Congress the right to limit the jurisdiction of those judges to real cases, and not to social issues that are properly the realm of legislators, whether in the states or in the Congress.

Perhaps you’ve heard about “safe zones” – where college presidents tremble, apologize, even resign, because a student’s feelings were hurt somewhere on campus.
But that seems to come to pass only when racial agitators, or feminists and gays and the occasional “transgendered” darling announce that they feel offended.
Because when conservative students receive dangerous threats that would normally shut down a campus, the obsequious, fawning administrators stop their simpering, and suddenly turn into macho left-wing bullies, launching ideological attacks on their students instead of defending them.
Case in point – Ohio State.
I am a big fan of the Buckeyes’ University’s football coach, Urban Meyer, who is pro-family and isn’t afraid to say so, even on his left-wing campus.
But I can’t say the same for the law school faculty there. In fact, that faculty seems to be full of bullies and thugs.
Here’s why. When one of their most prominent students received an anonymous threat from one of her classmates, she went to the dean’s office to report it.
Instead of helping her, three deans ganged up to browbeat and badger her for her beliefs, instead of protecting her from a potential campus terrorist – all because she’s a conservative.
Madison Gesiotto is an accomplished second-year Law Student, an editor of the student law journal, and a former Miss Ohio USA. She is also a gifted writer for the Washington Times. In her monthly column there this past September, she stated a simple fact:
“You won't believe what the number one killer of black Americans is,” she wrote “It isn't heart disease, it isn't cancer, it isn't homicide and it isn't motor vehicle accidents. In fact, the number one killer of black Americans is abortion.”
In the most recently published reporting year, black babies accounted for about 36 percent of the total number of children killed by abortions, she wrote.
That is to say, she continued, that in 2011, 402 black Americans were aborted in America every single day – almost the same number as white babies, even though there are five times as many white than black Americans, according to the census bureau.
In fact, the Center for Disease Control just revealed that 55.4% of babies killed every year by abortion are Black or Hispanic. In New York City, the number is 76.4.
Miss Gesiotto was not making a radical statement. In fact, just seven years ago, while Miss Gesiotto was still in high school, “Bishop Martin D. Holley, Auxiliary Bishop of Washington, called on African Americans to rededicate themselves to family, prayer and the dignity of the human person.” Bishop Holley, fully cognizant of the law of cause and effect, was “responding to information from the Guttmacher Institute reporting that black women have abortions at five times the rate of white women.”
Bishop Holley’s factual statement, and his call to prayer, were reported by the Catholic News Service. No law dean harassed him, no fawning leftist browbeat him, no fellow bishop threatened him.
But the Ohio State Lefties did all of that and more to Miss Gesiotto.
When she saw the anonymous threat on her facebook page, Madison did exactly what she was supposed to do: she called the dean’s office.
When she arrived, not one, but three deans were there, and they did not lift a finger to help her. Instead, thy launched a frontal attack on her article, her beliefs, and her rights, all the while avoiding the fact that she was there because she’d been threatened!
Hello – I came here for protection and now you’re threatening me!
Well, Miss Gesiotto, you’ve made the other “dean’s list” – the list that caviling, simpering, bullying left-wingers can’t stand: you’re a principled pro-lifer.
When she went to Law Dean Alan Michaels for protection, he and two other senior law professors subjected her to over an hour of hostile criticism – vilifying her article, which they deemed insufficiently sensitive to conditions in black America, and her writing abilities.
To top it off, the deans proposed that Miss Gesiotto participate in a study session with her critics as a way of reducing the threat.
Now think for a minute: If Law Dean Alan Michaels had treated a Black Lives Matter activist that way, or a confused Tranny or a Radical Feminist, what would have happened next?
The coddled masses would demand teddy bears. They’d demand that classes be cancelled. They’d demand justice for Trannies.
And Dean Michaels would be crawling on his knees to the Trustees to keep his job, tears of repentance flowing like a fountain on the quad.
Folks, this is abuse of power. And there is no greater abuse of power than in modern academe, where Leftie profs abuse their power all the time. They are afraid of the campus Lefties, but they feel free to take out their frustrations on their conservative students all the time.
I'm sure Dean Michaels went home to his domestic partner that night and pirouetted about his performance in the "counseling" session he and his fellow party members administered to Miss Gesiotto – right out of Mao’s re-education camps in China.
And let me give some advice to our millennial friends – law school’s a tough go these days already, with jobs so scarce and costs so high – but if you’re considering studying law, skip Ohio State; if you need to go in-state in Ohio for financial reasons, check out Professor Bruce Frohnen, a solid scholar at the Pettit College of Law at Ohio Northern University. At least you’ll get an education there.
The most charitable view would be that these deans are positivists. That’s the view of the Dictatorship of Relativism that Pope Benedict warned us about. Now, Positivism teaches that, whatever the government says is legal, is also moral. The founder of that theory a hundred years ago was Hans Kelsen. Well, Mr. Kelsen lived a long life, and after World War II, after several totalitarian regimes had taken him at his word and murdered tens of millions of innocent people, Kelsen insisted that there were no grounds to condemn them, because, after all, their crimes were permitted by law.
Back to the Buckeyes. Law Dean Alan C. Michaels said in a statement to The Times that the university "takes any alleged threat against its students very seriously," while asserting that federal law prevented him from discussing his behavior with Miss Gesiotto.
I hope that means that he’s been called on the carpet. But according to Miss Gesiotto, he and his fellow deans have never apologized.
Meanwhile, Miss Gesiotto has wisely reconsidered what classes to take. She’s concerned – and properly so – that taking courses from any of the Gang of Deans will lower her grade point average – and unfortunately, she’s probably right.
Ideological professors don’t want competition. They want to make sure that their gifted conservative students don’t get job offers, especially from Law Schools looking for young faculty members.
Unprofessional? You bet. Unethical? Absolutely. But most law schools gave up on truth a long, long time ago.
And that’s why today’s Supreme Court has done the same thing.

According to news reports, Pope Francis and the Holy See have been fervently pushing for a legally binding agreement on combating climate change in recent weeks.
On his way home from Africa, the pope told reporters that an agreement on climate change was needed to save a world “at the limits of suicide.”
That’s a pretty big order, but let’s look at what it entails.
On the practical level, a legally binding agreement between these many countries would have to be considered to be a treaty.
Now, The U.S. Constitution requires that a treaty receive the advice and consent of the U.S. Senate — two thirds of those Senators present and voting.
In fact, according to the Reuters news agency, Secretary of State John Kerry admits that the agreement was designed to avoid the U.S. Constitution.
Here’s their report, verbatim:
Secretary of State John Kerry said Sunday [that’s December 13, after the Paris meeting ended] the climate agreement reached this week in Paris did not contain any enforcement provisions because Congress would not have approved them.
"It doesn't have mandatory targets for reduction and it doesn't have an enforcement, compliance mechanism," Kerry said during an interview on "Fox News Sunday."
Kerry said such mechanisms were not included because Congress would have refused to greenlight the deal.
Binding legal requirements would have made the Paris agreement a treaty, requiring approval from two-thirds of the Senate. Because no climate change measure could come close to the high bar in the chamber, the Paris deal was written to avoid it.”

Well, folks, there you have it. This Climate Treaty that’s not a treaty will cost the world’s economy trillions in coming years, and those hurt most will be the poor.
So even though the treaty is a dead letter from the American point of view, that won’t get in the way of this administration, because the federal government hasn’t been very legal recently, and it won’t be this time around either.

How do we know this? Follow the money. And there’s a lot of money in climate change. It’s a giant scam that has made an astounding number of people very, very rich.
On Saturday, some 200 nations pledged that by 2020 they would cope with climate change and – mark this well – also wean themselves off fossil fuels.
Of course, this requires money.
Now it’s understandable that some 175 so-called poor nations would vote to receive two trillion dollars from the other 25 in the next decade or two. Aristotle pointed out long ago that, in a democracy, the poor will simply vote to take the money of the rich.
But why would developed nations agree to pay them?
Here’s the rub: it wasn’t actually developed nations, it was bureucrats and politicians from those nations. And they will make sure that they get a fat chunk of that cash right off the top.
Just this week, the Census Bureau announced that five of the seven richest counties in the United States are those counties that surround Washington DC. Nothing is manufactured there – nothing produced, nothing of value exported.
These five counties, all with a median household income of over $100,000 a year, are full of people who do nothing but take your money and spend it. As you can see, they manage to keep a lot for themselves.
So while you didn’t get to vote on giving away hundreds of billions to foreign autocrats, the folks in the bipartisan Washington hot tub thought that would be fine: more business, more commissions, and more swag for them and their cronies.
But don’t we want to stop global warming?
Well, first things first: Communist China, the most polluted economic powerhouse in the world today, is not going to pony up for anything. Yes, the Chinese Communist Party will continue to pursue its own interests by investing strategically throughout the world, but the corrupt criminal gang that runs China is certainly not going to finance their competition – and that means the corrupt criminal gangs in the Third World.
There is, after all, honor among thieves.
Pope Francis is well aware of this worldwide corruption. In his own home country of Argentina, President Christina Kirchner left office this week, taking with her billions of taxpayer dollars and passing it out to her political cronies around the country.
And these cronies intend to do everything possible to make the new government, from the opposition, non-Peronist party – a failure.
That’s right. They want a scapegoat for the disastrous condition they’ve left the country in. And they want perpetual chaos until they’re back in power.
Meanwhile, PRI Review’s Argentine correspondent tells us that outgoing President Kirchner, In her official tax disclosure, declares that her patrimony grew by 812% — that is not a typo — 812%! – during her presidency
That, my friends, is corruption, big time, major league – and that’s why Pope Francis condemned corruption so emphatically on his recent visit to Latin America – and why Pope Benedict insisted that any government efforts, national or international, must be informed and guided by the truth and love of Christ – or they will come to nothing.
And that goes for the Global Warming con game, too.
Ecology is inseparable from the culture, Pope Benedict said. “The book of nature is one and indivisible,” he wrote in his 2009 encyclical Caritas in Veritate . The physical world is inseparable from life, sexuality, the family, and social relations. “The deterioration of nature is closely connected to the culture which shapes human coexistence,” he said.
Yes, that culture is deteriorating, especially in the west. And the only way to restore that culture is through Jesus Christ. Otherwise, corrupt dictators will make sure the poor are excluded, and will cynically deny the poor the use of the fossil fuels without which they cannot heat their humble homes or cook their simple meals.
After all, the world’s poor countries are not poor because of us – they’re poor because they are ruled by tyrants, corrupt to the core. They do not have the rule of law to encourage individual initiative and dignity.
Pope Francis might have all the good intentions of the world, but, to put it bluntly, the vast majority of countries in that world are ruled by corrupt gangs who do not have good intentions.
It’s not likely that American millennials, burdened by hundreds of thousands of dollars in student debt, are going to appreciate seeing their loan payments go directly to third world dictators, no matter how enthralled they were with “climate change” in college.
And there is no question that’s where it will go. In fact, the Associated Press reports that no one knows how much has been spent out of all this money or where it’s going.
Believe me, that’s just how corrupt foreign dictators like it – and our own bipartisan corruptos who always make sure they get a generous slice right off the top.
And let’s not forget the international left – it is hard at work in Africa, conniving to get all of those millions that are supposed to go to the poor.
African campaigners are demanding compensation for what they call the damage being inflicted on the continent by global warming – they call it a problem that has been caused by the rich countries but will hit poor nations the hardest.
As the United Nations summit to tackle climate change nears its conclusion, African politicians and NGOs are calling for the developed world to provide cash to help them deal with the consequences of a warming planet.
Compensation should cover everything from storm damage and crop failure to desertification and forest degradation, the African nations say.
The funds should also help meet the cost of the mass migration that is inevitable as huge areas become uninhabitable, as well as the rise in diseases such as malaria.
“The cries of the people of Africa impacted by climate change are growing louder and louder as they are losing the farmlands and animals they rely on for their livelihoods to floods and droughts,” Mithika Mwenda, secretary general of the Pan African Climate Justice Alliance (PACJA), told The London Independent.
And deep in the heart of this movement we find the so-called “Deep Ecology” advocates – and here is their platform.
4. The flourishing of human life and cultures is compatible with a substantially smaller human population. The flourishing of non-human life requires a smaller human population.
Help the poor by eliminating the poor – billions of them. For the past one hundred years, that’s been the mantra of progressives who claim to help the poor.
So whenever you hear a starry-eyed college student talking about majoring in the “environment,” be advised that they’re going to be spoon-fed this drivel in the name of ecology and environmental philosophy.
Ok, one last note on the pope in Africa – and this goes to show that the militant left is never, ever satisfied, no matter how much the Church tries to be popular by championing the left’s welfare-state agenda in Washington.
The pope failed in Africa, says the New York Times – all because he failed to confront church leaders over the widespread prejudice against gay people there.
Well, we know what their priorities are.
Speaking of Pope Francis, last Monday he made a strong defense of the right of parents to demand that their children’s education be Authentically Catholic.
In comments to the Catholic Schools Parents’ Association, Pope Francis encouraged parents to strengthen the Catholic identity of schools by defending their “inalienable right” to educate their children and request that Catholic schools embrace Christian values and a proper understanding of the human person.
“It is your right to request an appropriate education for your children, an integral education open to the most authentic human and Christian values,” Pope Francis said. “As parents, you are the depositories of the duty and the primary and inalienable right to educate your children, thus helping in a positive and constant way the task of the school.”
“It is up to you, however, to see that the school is up to the measure of the educational task entrusted to it, in particular when the education proposed is expressed as ‘Catholic,’” he told the parents gathered at the Vatican.
The pope’s position is a welcome contrast to the view of America’s public school unions, who for 150 years have bitterly opposed parental control over education.
That’s right, 150 years. Back in the 1860s, John Swett, who is honored today as the founder of California’s largest public school union, hated Catholics, and did everything he could to remove parents from any control over the hiring of teachers or the setting of the curriculum. Those were the days when California was ruled by anti-Catholic Know-Nothings, not because they didn’t know anything, but rather, when confronted about their bigotry, their weasling response was “I know nothing.”
It’s no secret that American public education began as an anti-Catholic reaction to the Church’s wonderful works in the 19th century, building churches and schools by the hundreds and thousands throughout the country.
That anti-Catholic vitriol persists today, and Pope Francis has shown us the only way Catholic education can survive in coming years – to make sure that it is truly Catholic.
We should recall that Pope Francis was not addressing only primary and secondary Catholic schools.
Parents should also insist that their children attending Catholic colleges and universities have the same right to demand that their education be totally and thoroughly Catholic in character. Tell him Pope Francis sent you.
Here’s another item worth noting: pro-abortion politicians and their allies in the secular elites often tell us that a majority of Americans support a woman’s right to abort her child.
They’re dead wrong – in more ways than one. Lifesite news reports that Nearly 400 pro-life bills were introduced in state legislatures nationwide in the last year, and 47 passed.
That news comes from the so-called Center for Reproductive Rights – a pro-abortion powerhouse..
Over the last year, "extremist state lawmakers continued their assault on reproductive freedom, introducing almost 400 bills and enacting 47 new restrictions on access to reproductive health care," the Center complains – failing to note that every one of the legislators voting for those measures had been elected by a majority of their constituents.
After the Planned Parenthood videos, prolifers will win even more battles against the abortionists.
It’s interesting that few people noticed when Justice Anthony Kennedy described dismemberment abortions 15 years ago: “The fetus, in many cases, dies just as a human adult or child would: It bleeds to death as it is torn limb from limb. The fetus can be alive at the beginning of the dismemberment process and can survive for a time while its limbs are being torn off.”
Now that the videos have brought that message home to millions of Americans, the pro-abortion lobby won’t get away with that lie any more
